Since the legalization of marihuana and THC in many other states, individuals are being arrested as they travel through Texas for the possession of these substances because Texas has NOT legalized them. Therefore I would like to discuss the problems that arise.

THE OFFENSES IN TEXAS

     The Health and Safety Code in Texas which is where the controlled substances are defined and the punishments for offenses are set out. Marihuana (spelled Marijuana in other states) and THC (Tetrahydrocannabinol) have various punishment ranges determined by the weight of the substance seized which can include possible time in prison.

     Possession of these substances in Texas has entered a completely different phase as other states have legalized the possession of theses substances or made the use of them legal for medical treatment. Many individuals attempt to travel either through or to Texas while in the possession of these drugs and are being arrested and charged with severe criminal offenses as a result.

     I have had the opportunity to represent many such individuals from other states and Texas as they try to deal these type problems. There are many search and seizure factors that are important to explore as they may provide a manner in  which I can help people have the evidence suppressed and the case ultimately dismissed. Obviously each case differs factually, but it is always important to make sure the government does  not exceed their authority and violate an individual's constitutional protected rights and that is my primary goal in the representation of these type clients.
